Terms Of Service
These Terms of Service ("Terms") are an agreement between Fabian Martinez, doing business as Bruv Aviation, to be assigned to Bruv Aviation LLC (a Texas limited liability company now being formed) once it is registered ("Bruv," "we," "us"), and the shop, company or other organization that signs up for Bruv ("Customer," "you"), along with each person the Customer lets use it ("Users"). By creating an account or using Bruv, you agree to these Terms.
1. The Service
Bruv is a software service that helps aviation maintenance and restoration shops find information in their documents and FAA reference material, and keep track of parts, hours, receipts and photos (the "Service"). We may improve, change or discontinue features over time.
2. Who Can Use It
The Service is sold to businesses and organizations, not consumers. The person who signs up confirms they are authorized to accept these Terms for the Customer. Users must be at least 13 years old; the Customer is responsible for who it invites and for their use of the Service.
3. AI Answers Are Reference Only
Read this part. Bruv uses artificial intelligence. AI answers can be incomplete, out of date, or wrong. Bruv's answers are for reference only and never replace:
- the aircraft's own maintenance data, manuals and instructions for continued airworthiness;
- the FAA regulations and other applicable law; or
- the judgment of a certificated mechanic, inspector, or IA.
Always verify against the source document before doing work, and check that you are using the current revision. The certificated person performing or approving the work is solely responsible for it and for all maintenance records and sign-offs. Bruv does not approve, return to service, or sign off any aircraft or work, and does not fill out or alter FAA forms. Bruv is not approved, certified or endorsed by the FAA.
4. Accounts
Keep your sign-in details secure and tell us promptly about any unauthorized use. You are responsible for activity under your account.
5. Your Data
You own the data, documents and photos you put into Bruv ("Customer Data"). You give us permission to host, process, and transmit Customer Data only as needed to provide and support the Service, including sending relevant data to our AI provider as described in our Privacy Policy. You confirm you have the right to upload the documents and manuals you put into Bruv. We do not sell Customer Data.
6. Acceptable Use
Don't use the Service to break the law, infringe others' rights, upload malware, try to access other customers' data, reverse engineer or overload the Service, or resell it without our written permission.
7. Fees And Billing
Paid plans are billed as described at sign-up or in your order. Fees are due in advance, are non-refundable except where required by law, and do not include taxes. We may change prices with at least 30 days' notice, effective at your next renewal. We may suspend the Service for accounts more than 15 days past due.
8. Term And Termination
These Terms last while you use the Service. You may stop at any time and delete your account in the app. We may suspend or end access if you materially breach these Terms. After termination, Customer Data is deleted as described in our Privacy Policy.
9. Our Property
The Service, its software and the Bruv name and marks belong to Bruv Aviation (Fabian Martinez until Bruv Aviation LLC is registered). We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you give us may be used freely to improve Bruv.
10. Third-Party Material
The Service includes publicly available FAA material and relies on third-party services, including an AI provider. We are not responsible for third-party material or services, and FAA material may change after it is loaded into Bruv.
11. Disclaimer Of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANSWERS WILL BE ACCURATE, COMPLETE OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation Of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW: (A) BRUV WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR USE, OR FOR ANY DAMAGE TO OR LOSS OF ANY AIRCRAFT, PROPERTY, OR PERSON ARISING FROM RELIANCE ON THE SERVICE; AND (B) BRUV'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT THE CUSTOMER PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF NOTHING WAS PAID.
13. Indemnity
The Customer will defend and indemnify Bruv against third-party claims arising from the Customer's or its Users' maintenance work, Customer Data, or breach of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Harris County or Brazoria County, Texas, and both parties consent to those courts.
15. Changes
We may update these Terms. For material changes we'll give notice in the app or by email at least 30 days before they take effect. Continued use after that means you accept the updated Terms.
16. General
These Terms, with the Privacy Policy and any order form, are the whole agreement between us. If any part is unenforceable, the rest stays in effect. You may not assign these Terms without our consent. Failure to enforce a term is not a waiver.
